Terms of Service

These Terms of Service ("Terms", "Agreement") govern your access to and use of the Ohu Web Intelligence Platform, developer APIs (`https://sluxia.com/ohu/api/v1/*`), Remote Model Context Protocol (MCP) Server (`/ohu/mcp`), documentation, and associated software provided by Sluxia Inc. ("Sluxia", "we", "us", or "our").

1. Acceptance of Terms

By creating an account, generating an API Key, connecting an MCP client, or invoking any Ohu API endpoint, you confirm that you are at least 18 years old (or possess legal corporate authority), have read and understood these Terms, and agree to be bound by them in full. If you do not agree, you must immediately cease accessing the platform.

2. Account Registration & API Key Custody

  • Credential Accuracy: You must provide accurate, current email information upon account registration.
  • API Key Confidentiality: You are solely responsible for maintaining the security of your raw API keys (`ohu_live_...`). Keys grant immediate access to your plan quotas.
  • Compromise Notification: If an API key is leaked or compromised, you must immediately delete or revoke the key via the Developer Console and notify ohusupport@sluxia.com.

3. Acceptable Use Policy (AUP)

You agree NOT to use Ohu APIs or MCP tools for any prohibited activity, including but not limited to:

  • Unlawful Crawling: Target scraping of protected personal data in violation of applicable laws (GDPR, CCPA, CFAA) or bypassing explicitly enforced authentication walls without legal right.
  • Denial of Service Attacks: Utilizing Ohu as a proxy or botnet tool to perform Distributed Denial of Service (DDoS) attacks against third-party websites.
  • Malware & Injection Exploits: Weaponizing prompt injection scanners or web crawlers to distribute malicious payloads, viruses, or phishing links.
  • System Interference: Attempting to reverse engineer, decompile, or overload Ohu backend services or bypass rate-limiting infrastructure.

Violation of the Acceptable Use Policy results in immediate, permanent account suspension and API key invalidation without refund.

4. Service Tiers, Quotas & Subscription Billing

  • Monthly Quotas & Burst Limits: Free Developer (100 req/mo, 10 req/min burst), Starter ($29/mo, 2,500 req/mo, 60 req/min burst), Pro ($99/mo, 12,500 req/mo, 180 req/min burst). Exceeding burst limits returns `HTTP 429 Too Many Requests`. Exceeding monthly quotas returns `HTTP 402 Payment Required`.
  • Stripe Payment Processing: Paid plans auto-renew monthly via Stripe. Subscriptions can be managed or canceled anytime via the Stripe Customer Portal in the Developer Console.
  • No Refund Policy for Consumed Quotas: Paid subscription fees are non-refundable once quota usage has commenced within a billing cycle.

5. Intellectual Property Rights

  • Ohu Platform Ownership: Sluxia Inc. retains all rights, title, and interest in and to the Ohu service, code, API algorithms, documentation, brand logos, and trade secrets.
  • Target Content Ownership: Sluxia claims zero ownership over third-party text, images, or documents scraped or converted on your behalf. You retain all underlying rights and assume full responsibility for compliant usage of target web content.

6. Service Availability & SLA

We strive for 99.9% platform availability. However, Ohu APIs are provided on an "AS IS" and "AS AVAILABLE" basis. Temporary downtime may occur due to scheduled maintenance, third-party network outages, or upstream web target changes.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SLUXIA INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. IN NO EVENT SHALL SLUXIA’S AGGREGATE LIABILITY EXCEED THE TOTAL FEES PAID BY YOU TO SLUXIA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Sluxia Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your violation of these Terms or misuse of the API services.

9. Governing Law & Dispute Resolution

These Terms are governed by international commercial laws and the state laws of Delaware, US, without regard to conflict of law principles. Any dispute shall be resolved through good-faith negotiation, or binding arbitration if unresolved within 60 days.
